The Indian government has moved to limit the authority for ordering social media content takedowns, a move directly following a highly publicized spat with Elon Musk’s X (formerly Twitter). The new policy restricts content removal requests to a smaller number of senior, designated officials.
This shift is a response to international pressure and legal challenges regarding the broad and sometimes opaque authority previously used to censor online speech. The previous rules allowed a wider array of government officials to issue takedown orders, which often led to accusations of arbitrary censorship. The conflict with X centered on the interpretation and legality of these broad powers.
By concentrating the authority, India aims to introduce a degree of accountability and procedural clarity to the content moderation process. This represents a partial concession in the ongoing battle between democratic governments seeking control over online discourse and global tech platforms advocating for free speech principles.
